Timeline of challenge to Section 377

The first challenge to Section 377 IPC in the Supreme Court came in 1994, when an NGO--AIDS Bhedbhav Virodhi Abhiyan--filed a petition seeking scrapping of the law. The next major challenge came in 2001 when Naz Foundation, another NGO working for prevention of HIV/AIDS, entered the legal battle with a petition in the Delhi High Court seeking decriminalisation of homosexual act in private between two consenting adults. Since then, the matter has gone through a long legal battle. In 2009, the Delhi High Court had read down Section 377 and decriminalised homosexuality. However, the verdict was turned down by the Supreme Court in 2012. CLICK HERE TO READ MORE

I seriously love what the CJI said in this judgement

"Societal morality cannot trump constitutional morality. societal morality cannot overturn fundamental rights of even a single individual"

Some top quotes from the verdict:

Section 377 is arbitrary. LGBT community posses rights like others. Majoritarian views and popular morality cannot dictate constitutional rights

No one can escape from their individualism. Society is now better for individualism. In the present case, our deliberations will be on various spectrums

To deny LGBT community of their right to sexual orientation is a denial of their citizenship and a violation of their privacy

Autonomy of an individual is important. He or she can not surrender it to anyone

Homosexuality is not a mental disorder

As an Indian I didn't expect this to happen for at least another 10-15 years. A landmark decision and a historic day.
