A 40-year-old man has been fined $1,100 for breaking into a council pound to free his "best friend".

The Kalgoorlie Magistrate's Court heard Yarran Scott Dimer, from the small town of Norseman in Western Australia's Goldfields, cut a hole in the perimeter fence and smashed a padlock as part of the jailbreak, which occurred sometime between midnight and 6am on October 6 last year.

He pleaded guilty to charges of trespass and criminal damage.

The court was told Dimer's unregistered dog had been impounded by the Shire of Dundas the day before and had given birth to seven puppies.

Magistrate Genevieve Cleary said it was the second case she had presided over in recently in which a person had broken into a pound to free their pet.

She said the other matter involved a man in Esperance but the significant point of difference was he broke in during the day and "frightened the staff".

She told Dimer it was a "very serious offence".

"Councils are entitled to control animals in their domain," she said.

"There are rules which we all need to follow … I note you haven't done anything like this before.

"I need to send a message to the community that people cannot take matters into their own hands.

"At least in your case you didn't frighten the staff."

Magistrate Cleary fined Dimer $800 for trespassing, $300 for criminal damage and ordered him to pay $259.30 in court costs and $50 in compensation to the Shire of Dundas.

Speaking outside court today, Dimer said it was a "silly mistake" and described the dog as "my best friend".

"I was in Perth at the time," he said.

"I got back home and they had taken it that morning.

"I was drunk at the time and pissed off."

Dimer said he still has the dog and intends to register her.

"Yes, as soon as I get home," he said.

He has given away the seven puppies from the dog's litter.
