Even this misunderstands the situation. Having data on or off has no effect on whether the cell phone company knows where you are, and they will tell the FBI when the FBI comes to them and says "we need the info on all the terrorists that attacked the capitol". In order for a cell phone to even work it has to talk to cell towers which means the cell company knows where you are. Hell, all things considered, they probably just sent the cell companies a list of SIM cards of all the cell phones that pinged the internal network of the capital.
