Police: Son chokes mom’s ex-boyfriend to death after seeing him beat her

NEW YORK — A woman's son allegedly choked his mother's ex-boyfriend to death Monday after spotting the man beating her inside their New York City apartment, police said.

The 43-year-old ex-boyfriend showed up at the University Avenue unit in the Bronx around 4:30 a.m. to talk to the mother, police told WPIX. The two argued in the hallway, then he followed her into the apartment.

The man, who police didn't immediately identify Monday, then began beating the 37-year-old woman, officers said. Her 18-year-old son heard what was happening and rushed out of his bedroom.

The teen allegedly fought with his mom's ex-boyfriend, pulling him off of his mother before choking the man to death, police said.

Police sources said the mother, who had briefly passed out, woke up to the sight of her son standing over her ex-boyfriend.

The dead man has 26 prior arrests, two for domestic violence against the teenager's mother, sources told WPIX.

Police took the teen into custody. No charges have been filed as of Monday evening.

Based on the circumstances, I'd say the kid has a legally sound case for self-defense:

he sees the man in the process of seriously injuring his mother

intervenes to protect her

chooses not to release his chokehold on the assailant out of a reasonable fear for both he and his mother's safety should the man be able to resume his assault.

Add on top of that any judge and/or jury's understandable innate sympathy toward the defendant and against the decedent, and I would say this kid has a reasonable chance at walking.

That poor kid; he's just old enough too be tried as an adult, and I'm hoping he'll get off on a self-defense plea. That scumbag deserved what he got. 26 prior charges? I mean fuck.

I thought, at first, considering him dying justice for that might be a bit harsh but then I read:

You can't take risks with a guy like that. You don't know when the next time he does something like this would result in his victim being the one who dies. I fully support what the kid did.
