The former president's daughter Ivanka Trump lost her bid Thursday to pause her upcoming testimony on Wednesday, shortly after her father is anticipated to take the stand in his $250 million civil fraud case.

The two-page order of New York's Appellate Division, First Department rejected her motion for a stay pending appeal.

Though it does not resolve the underlying appeal, the court refused to freeze Ivanka Trump's subpoena requiring her testimony before she is scheduled to take the stand.

Trump moved for a stay after Manhattan Supreme Court Justice Arthur Engoron, who's presiding over the civil fraud case, a week ago ordered her to testify, denying a motion from her attorney to quash the subpoena compelling her testimony.

The public has the right to "every person's evidence," the judge said then.

Engoron ruled then that Trump would not have to testify until after Nov. 1, giving her time to appeal his decision.

Ivanka Trump's brothers Eric Trump and Donald Trump Jr. both testified on Thursday. Their father, former President Donald Trump, is scheduled to testify on Monday.

All of the men are defendants in the lawsuit.

Ivanka Trump was originally also named as a defendant, until she succeeded in dismissing the claims against her on appeal under the statute of limitations.

Trump's attorneys argued in part that that the required testimony in the middle of a "school week" created an "undue hardship."
