Prosecutors want to know how intoxicated Rudy Giuliani was during and after the 2020 election.

They also want to know if Trump knew that Giuliani was drunk when he was advising the former president.

An aide testified that Giuliani was "intoxicated" on Election Night 2020 but Giuliani said he was only drinking Diet Coke.

Federal prosecutors working for the special counsel Jack Smith have questioned witnesses about how drunk former New York mayor Rudy Giuliani was during and after the 2020 election.

That's according to Rolling Stone, which reported that Smith's team has asked multiple people about Giuliani's level of intoxication on and after Election Night 2020, and whether Donald Trump knew Giuliani was drunk when he was advising him on overturning the election results.

Investigators have also asked witnesses if Trump gossiped about Giuliani's drinking, and if the former president ever said Giuliani's drinking habits affected his judgment.

One Trump aide, Jason Miller, previously said Giuliani was drunk at the White House's 2020 election night party.

"I think the mayor was definitely intoxicated, but I do not know his level of intoxication when he spoke with the president, for example," Miller testified to Congress' Jan. 6 committee. Giuliani pushed back on that claim, saying that he was drinking Diet Coke all night.

But Miller's testimony was consistent with details published in "I Alone Can Fix It: Donald J. Trump's Catastrophic Final Year," by The Washington Post's Carol Leonnig and Philip Rucker.

According to the book, Giuliani was "causing a commotion" on election night, prompting several people around him to speculate that he was drunk.

The author Michael Wolff made similar claims in his book, writing that Trump's aides thought Giuliani was usually drunk and on the verge of senility.

The Justice Department charged Trump with four counts earlier this month over his efforts to overturn the 2020 election. He and Giuliani are also co-defendants in a sprawling RICO case in Georgia accusing them and 17 others of carrying out a racketeering scheme to nullify the 2020 election results in Georgia.

"One should always question a story that is completely reliant on anonymous sources," Ted Goodman, a political advisor to Giuliani, told Insider. "This false narrative by nameless sources has been contradicted by on-the-record witnesses."
