A lawyer for Donald Trump has said the former president is prepared to testify to the January 6 House Select Committee as he has "nothing to hide."

Attorney Alina Habba told Newsmax's Eric Bolling that the former president, who is accused of inciting the violence at the Capitol in his attempts to overturn the 2020 election results, will not go down the same route as his former White House adviser, Steve Bannon, after he was subpoenaed by the January 6 panel.

Bannon was recently sentenced to four months in jail after being convicted of two counts of criminal contempt of Congress for refusing to comply with his January 6 subpoena.

At the end of their possible final presentation, the committee investigating the Capitol riot unanimously voted to subpoena Trump in order to force him to testify under oath and provide documents related to their investigation.

The committee has now given Trump a deadline of November 4 to provide the requested documents, and for him to appear for deposition testimony beginning on or around November 14.

"I would recommend that he cooperate because when you have nothing to hide, that's what I always recommend," Habba said.

"He has no issue being deposed, even though the left-wing media would like to pretend that he does. He has no issue being subpoenaed and answering questions about what happened that day, and he should.

"What he did was very public, and it was really nothing other than to say to go out peacefully," Habba said, in an apparent reference to the speech Trump gave at the Ellipse in Washington, D.C. on January 6, 2021, where he told his supporters protesting the 2020 election results that if they don't "fight like hell, you're not going to have a country anymore."

Habba suggested that Nancy Pelosi should also be subpoenaed while pushing the widely disputed claim that Trump formally requested additional National Guard troops be brought into D.C. on January 6, which the House speaker denied.

There is no evidence Trump made such an order, and Pelosi does not have the authority to enlist National Guard troops at the Capitol.

Habba also criticized Pelosi for her comments shown at the last January 6 hearing of her threatening she would "punch him out" if Trump arrived at the Capitol on January 6.

"Sometimes less is more, Nancy, you shouldn't just keep going," Habba told Newsmax.

"We saw a real glimpse of who she is, and who [Senate Majority Leader Chuck] Schumer and all these individuals are.

"She was silly enough to have somebody taping her say that. It's one thing when people get taped and tricked, but she welcomed those people in and stated that that's how she felt about a standing president. That's disgusting. That's disgusting and she should be ashamed," Habba said.

Trump has given no indication if he will testify to the January 6 panel following his subpoena. Even if he does, there is still the chance he may plead to the Fifth Amendment and refuse to fully answer the questions.

If he does not comply, like Bannon, it is unlikely the Department of Justice will indict the former president, like how they opted not to charge former White House chief of staff Mark Meadows and ex-deputy chief of staff Dan Scavino after they refused to comply with their January 6 subpoenas.

and he will find an excuse at the last minute. This is exactly what he does every time. He pretends to comply and they finds some trick to not comply in which he can blame someone else.

He was happy to give up his tax returns BUT.....
