Interestingly; Tolken actually did grapple with his writing the orks as bad guys for years. Not so much with the idea that orks all acted evil (he fought in a war, he understood what conditions can drive you to do) but with the idea that Orks do have souls and were capable of being good, but he simply never gave them the opportunity to exercise any freedom to do so.
It was probably necessary from a structural perspective for the story to have these faceless goons, but I think it speaks volumes about Tolkien that he felt continuing guilt about mistreating plot objects in his story.
