Decriminalize marijuana instead of legalizing it.

A New Jersey man who was driving on Burlington Road in Southampton had a very personal run-in with New Jersey State Police officers who contend they smelled marijuana on his person, according to a report.

In a dashcam video published by open government advocate John Paff, two State Police officers are seen ramming their hands down the pants of Jack Levine during a traffic stop.

"If you think this is the worst thing I'm going to do to you right now, you have another thing coming my friend," one of the troopers, identified on the video as Joseph Drew, tells Levine before beginning the cavity search.

The officers — the other one was identified as Andrew Whitmore — were ultimately unable to locate any marijuana and cited Levine for tailgating. Their interaction with the motorist was reported by New Jersey 101.5.

"Did you find it? Did you find it? Yo, you guys are really ridiculous," Levine says in the video. "You might as well ask me on a (expletive) date."

Levine filed a tort claim noting his intention to sue over the incident. In the claim, he alleges the New Jersey State Police delayed his attorney's requests for the dashcam videos. After finally watching the videos months later, he alleged that both officers violated him.

"It was the most humiliating experience I've ever been through, also due to the fact people were driving by very slowly, watching him with his hand down my pants," Levine said in his motion.

The video comes as New Jersey lawmakers continue to debate whether the state should legalize marijuana. Gov. Phil Murphy has vowed to sign a bill by the end of the year though it’s still unclear whether the measure would have the votes in the Legislature to pass.

Last week, the Murphy administration expanded the state’s long-flailing medical marijuana program, allowing doctors to recommend the drug for five new medical conditions and for patients to nearly double the amount of medical marijuana they can purchase.

On Tuesday, the Division of Consumer Affairs announced that it would hold “informal conferences” with members of the public in Newark and Trenton to discuss whether marijuana should be reclassified.

Both the state Consumer Affairs division and the federal Justice Department currently classify weed as a “Schedule I” drug, which means that it has no medical use, high potential for abuse and is in line for strict regulations. Other Schedule I drugs include heroin and LSD.

LETTER: Weed is misclassified, shouldn't be Schedule I

Last year, an appellate court ruled that the time was “certainly ripe” for the state to reevaluate marijuana’s classification, despite the drug remaining illegal on the federal level. If weed is reclassified, the state could change regulations or lighten penalties – but it still wouldn’t be legalized or decriminalized.

The hearings are scheduled in Newark on April 19 and Trenton on April 24. Anyone interested in speaking should submit a request to the Division of Consumer Affairs at this link, including prepared remarks.

Members of the public can offer their opinions on:

Marijuana’s actual or relative potential for abuse;

Whether marijuana is an “immediate precursor” of another Schedule I drug – if it’s a “gateway drug.”

A body cavity search is not permitted in New Jersey unless it is a part of custodial confinement. If a suspect is brought into custody under the officer in charge’s authority, either to an adult correctional facility or to a municipal detention facility, and authorizes a search of the suspect’s body cavities, they can do the search, but ONLY IF you consent, OR the police have a search warrant to do so.

Those cops are in trouble, they broke the law, department procedure and violated that man's rights to unreasonable search and seizure.

Edit: Over 2k upvotes thats a reddit milestone for me. Don't bother replying with "the cops won't get punished just put on admin leave" or "welcome to America" you're saying the same shit a few dozen people already said.

Doesn't this kind of search require a warrant or the individual to be incarcerated?
